1. Introduction

Welcome to LifeCache ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the LifeCache application, website, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

The Service is not directed to, and may not be used by, children under the age of 13. In compliance with the U.S. Children's Online Privacy Protection Act ("COPPA"), we do not knowingly collect, use, or disclose personal information from anyone under 13. You must be at least 13 years old to create an account or use the Service. When you create an account, you must affirmatively agree to these Terms, which includes confirming that you are at least 13 years old. By creating an account and accepting these Terms, you represent and warrant that you meet this age requirement. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that you have your parent or guardian's permission to use the Service and that they have reviewed and agreed to these Terms on your behalf. If we learn that we have collected personal information from a child under 13, we will delete that information and terminate the associated account as soon as reasonably possible. If you believe a child under 13 has provided us with personal information, please contact us at support@lifecache.ai so we can take appropriate action.

3. Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Content

The Service allows you to upload, store, and organize photos, text, and other content ("User Content"). You retain all ownership rights to your User Content. By uploading User Content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service. You are solely responsible for your User Content and represent that you have all necessary rights to upload and share it. You agree not to upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Scrape, harvest, or collect information from other users without consent
• Use the Service to send spam or unsolicited communications
• Impersonate any person or entity

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by LifeCache and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Book Printing and Orders

LifeCache offers the ability to create and order printed photo books. When you place an order:

• All prices are displayed in USD and are subject to change
• Payment is required at the time of order
• Orders are processed by third-party printing partners
• Shipping times and costs vary by location
• We are not responsible for delays caused by shipping carriers

Refunds and returns are handled on a case-by-case basis. If you receive a defective product, please contact us within 14 days of delivery.

8. Subscription Services

LifeCache offers subscription plans that provide access to enhanced features and increased storage limits. By subscribing to a paid plan, you agree to the following:

Billing and Payments

• Subscriptions are billed in advance on a monthly or yearly basis depending on your selected plan
• All payments are processed securely through Stripe
• Prices are displayed in USD and may be subject to applicable taxes
• You authorize us to charge your payment method on a recurring basis until you cancel

Cancellation Policy

30 Days Notice Required: To cancel your subscription, you must provide at least 30 days notice before your next billing date. Cancellations made with less than 30 days notice will take effect at the end of the following billing period.

• You can cancel your subscription at any time through your Account Settings or by contacting support
• Upon cancellation, you will retain access to your paid features until the end of your current billing period
• No refunds are provided for partial billing periods
• After your subscription ends, your account will be downgraded to the Free plan

Downgrade Behavior

If you downgrade or your subscription expires, your existing photos and yearbooks will be preserved. However, you will not be able to upload new photos if you exceed the Free plan's storage limit. You may delete photos to return within your limit or resubscribe to regain full access.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also delete your account at any time through your account settings. We will make reasonable efforts to allow you to export your User Content before deletion.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA OR CONTENT. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFECACHE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

Your privacy is important to us. This section describes how we collect, use, and protect your information.

Information We Collect

• Account Information: Name, email address, and password when you create an account
• User Content: Photos, text, and other content you upload to the Service
• Usage Data: Information about how you use the Service, including features accessed and actions taken
• Device Information: Browser type, operating system, and device identifiers
• Payment Information: Billing details when you place orders (processed securely by third-party payment providers)

How We Use Your Information

• To provide, maintain, and improve the Service
• To process your orders and transactions
• To communicate with you about the Service
• To detect and prevent fraud and abuse
• To comply with legal obligations

Data Storage and Security

Your User Content is stored securely using industry-standard encryption and security practices. We use reputable cloud service providers to host your data. While we implement safeguards to protect your information, no method of transmission or storage is 100% secure.

Data Sharing

We do not sell your personal information, and we do not share it with data brokers or advertisers. We share your information only with service providers (subprocessors) that help us operate the Service, under contract and bound by confidentiality obligations: cloud storage (DigitalOcean Spaces); AI providers used to score, caption, and lay out your photos and generate book text (Google Gemini API and Anthropic Claude API — used for real-time processing only, not to train their models); print fulfillment (Prodigi), which receives only the final rendered book file when you place a print order; and payment processing (Stripe), which never receives your photos.

Your Rights

You have the right to access, correct, or delete your personal information. You can export your data or delete your account through your account settings. For any privacy-related requests, please contact us at the email address below.

Google User Data (Google Photos)

LifeCache offers an optional "Import from Google Photos" feature. If you use it, the following applies to data obtained through Google APIs:

• Data we access: Only the specific photos you select in the Google Photos picker — including the image file and its embedded metadata (capture date/time, GPS location if present, and camera/device model). We request read-only access and do not access your full Google Photos library, albums, people/faces, or any photo you do not explicitly select.
• How we use it: Selected photos are added to your LifeCache library and used solely to provide the Service to you — organizing photos by date and location, automatically scoring and selecting high-quality photos, grouping them into events, generating captions, titles, and short narrative text, and laying them out into your printed and digital photo books. We do not use your Google photos for advertising, and we do not sell them.
• How we share it: As described under "Data Sharing" above — with our cloud storage, AI processing (Google Gemini and Anthropic Claude, for real-time processing only, not model training), and print-fulfillment subprocessors. We do not share Google user data with data brokers or advertisers.
• How we protect it: Google user data is encrypted in transit (TLS/HTTPS) and at rest, access is restricted to your authenticated account and the systems that build your books, and your Google authorization tokens are stored encrypted at rest.
• Retention & deletion: Imported photos remain in your LifeCache library until you delete them or delete your account. You can delete photos in the app and disconnect Google Photos at any time — disconnecting deletes our stored Google authorization and revokes our access token with Google. When you delete your account, your imported photos and their files are permanently deleted from our storage, and we remove your stored Google authorization and revoke our access with Google.

LifeCache's use of information received from Google APIs will adhere to the Google API Services User Data Policy , including the Limited Use requirements.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the United States.
